This site is owned and operated by AirWorkspace, with company number 614961, and with registered address 14-16 Dame Lane, Dublin 2, Ireland and references below to “AirWorkspace” are to AirWorkspace Limited. These Terms apply to your use of AirWorkspace.io. We offer a service through which users of the AirWorkspace can search for and book a work space, with the operators of that space.
ACCEPTANCE OF TERMS
Through its online presence and network, AirWorkspace provides you with access to search and choose and also facilitates the booking of co-working spaces, office spaces, workshop spaces, meeting rooms etc.
The Site is an online community which enables corporate professionals, organisations, entrepreneurs, startups etc. to access and/or purchase services from time to time made available on the AirWorkspace.
AirWorkspace is an aggregator of office spaces, co-working spaces, commercial spaces etc., and facilitates the advertisements / listings of properties and leasing of commercial spaces etc. AirWorkspace is not the owner / lessor of the properties / commercial establishments listed on AirWorkspace.
The user expressly undertakes to execute any written document / agreement, if required by the Lessor, on availing the services from AirWorkspace. The Services rendered by AirWorkspace, include any updates, enhancements, new features, and/or the addition of any new Web services, are subject to the TOU.
You are requested to read this TOU carefully. By using this website AirWorkspace.io or ordering or purchasing any product or service from this website, you agree to accept and be bound by all the TOU of this agreement.
Airworkspace does not at any time provide, or purport to provide, any advice, or advisory services, to ‘Landlords’, ‘Tenants’ or any other party, in particular with respect to the commercial, financial, legal or any other consequences of any rental agreement. Airworkspace disclaims all liability relating to the provision of advice relating to the property. ‘Landlords’ and ‘Tenants’ accept that Airworkspace’s role is limited to no more than that of a facilitator. Airworkspace reserves the right at its sole discretion to remove listings from the Website, illegal, inaccurate or misleading content, including anything that in its opinion is injurious to Airworkspace’s goodwill or goodwill attaching to the Website, without notice. Airworkspace reserves the right, at its sole discretion, to modify the Site, Application or Services or to modify these Terms, including the Service Fees, at any time and without prior notice. If we modify these Terms, we will post a notification on the Site or via the Application or otherwise provide you with notice of the update in the “Last Updated Date” section at the top of these Terms. By continuing to access or use the Site, Application or Services after we have posted a modification on the Site or via the Application or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified Terms. If the modified Terms are not acceptable to you, your only recourse is to cease using the Site, Application and Services.
A ‘Landlord’ is any user who manages a space/s on Airworkspace.
Airworkspace is not responsible for the conduct of any prospective ‘Tenant’ during the negotiations of any Tenancy Agreement. ‘Landlords’ accept that any decision to let a property to a particular ‘Tenant’ is made solely by the ‘Landlord’ without any representation, warranty or statement made by Airworkspace. Airworkspace has no obligations to ‘Landlords’ to reinstate or repair, any properties let by ‘Landlords’ at the end of any tenancy agreement. ‘Landlords’ understand and agree that they are solely responsible for determining (i) your applicable Tax reporting requirements, and (ii) the Taxes that should be included, and for including Taxes to be collected or obligations relating to applicable Taxes in Listings. You are also solely responsible for remitting to the relevant authority any Taxes included or received by you. Airworkspace cannot and does not offer Tax-related advice.
A ‘Tentant is any user who expresses interest in a space on Airworkspace. Interest can include; ‘Enquiries’, ‘Requests’ or browsing the site. If you are a potential ‘Tenant’, when you have identified a property on Airworkspace which meets your requirements you submit an enquiry to the ‘Landlord’ via the Website. The ‘Landlord’ will then promptly respond, either accepting your enquiry or declining it. If the offer is accepted you will enter into an agreement with the ‘Landlord’ either on the template terms or specific terms advised by the ‘Landlord’.
‘Tenants’ must comply with the terms of their agreement with the ‘Landlord’, including any special terms or requirements that may be specified by the ‘Landlord’. ‘Tenants’ are responsible for insurance against risks normally borne by occupiers of commercial premises or otherwise specified by the ‘Landlord’. If a ‘Tenant’ has any doubt about what insurance is required they should consult their own insurers or insurance brokers. ‘Tenants’ are responsible for satisfying themselves that a listed property fits their requirements, both as regards the specific features and amenities at the property and as regards the location. Airworkspace does not guarantee that properties listed by ‘Landlords’ are of suitable condition to be let or that ‘Landlords’ have the right to enter into rental contracts and to receive rental payments in respect of the properties. ‘Landlords’ are responsible for the legality, accuracy and completeness of the description of all properties and related terms posted on the Website. Airworkspace disclaims all liability for the legality, accuracy or completeness of any rental offers or content posted by ‘Landlords’ and in respect of any proposed rental contract that fails to complete for any reason whatsoever. Rental contracts are made exclusively between ‘Landlords’ and ‘Tenants’. Airworkspace is not a party to any rental contract, or negotiation to any rental contract, and does not fulfil any obligations derived from the contractual relationship between ‘Landlords’ and ‘Tenants’. Airworkspace does not make or accept any offers, either in its own capacity or on behalf of either ‘Landlords’ or ‘Tenants’ or any other party. Airworkspace disclaims all liability arising from or related to any rental contract to the fullest extent permitted by law. ‘Tenants’ must ensure that Fire and Safety standards are maintained at all times. Equipment, furniture or storage must never block or impede access or egress from the building. Fire exits and equipment must be kept clear and available at all times.
PERSONAL AND NON–COMMERCIAL USE LIMITATION
Unless otherwise specified in writing and accepted by the Lessor, you may not sub-let / sub-lease the said commercial spaces, office space, co-working space to any third party without prior permission with the Lessor in writing.
The copyright and all other intellectual property rights in the site belong to AirWorkspace and / or its licensors. By accessing and using the site, or any other services of AirWorkspace, you agree to be governed by the TOU of this agreement as well as any other specific terms / rules / policies / guidelines prevailing or posted on the site.
MEMBER, ACCOUNT, PASSWORD, AND SECURITY
The registration information you provide must be accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your AirWorkspace account.
You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify AirWorkspace immediately of any unauthorised use of your account or any other breach of security. AirWorkspace will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by AirWorkspace or another party due to someone else using your account or password. You may not use anyone else’s account at any time, without the permission of the account holder.
NO UNLAWFUL OR PROHIBITED USE
As a condition of your use of the Services, you will not use the Services for any purpose that is unlawful or prohibited by these TOU and / or any document executed in writing between the Parties. You may not use the Services in any manner that could damage, disable, overburden, or impair any AirWorkspace server, or the network(s) connected to any AirWorkspace server, or interfere with any other party’s use and enjoyment of any Services. You may not attempt to gain unauthorised access to any Services, other accounts, computer systems or networks connected to any AirWorkspace server or to any of the Services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services.
Advertisements are being posted on our websites by lessors and other third parties. The Advertiser is solely responsible to make sure that they comply with all the National and International Laws. In no way, is AirWorkspace responsible for any negligence, error, claims, demands on the advertised data, information or material. Advertisers agree and give their consent on all the TOU. All rights of the Advertiser unless documented in writing shall be expressly governed under the provisions of this TOU.
CLIENT’S RIGHTS, OBLIGATIONS AND RESPONSIBILITIES
You accept that, following the execution of a Contract as per your organisation’s requirements, the rights, obligations and responsibilities of the CLIENT are as under:
All information, furnished by you, are true, accurate and correct;
It shall be up to you (the Client) and any “lessor” to agree how to fulfil / execute the terms of the Contract, in writing, if required by the lessor;
AirWorkspace’s RIGHTS, OBLIGATIONS AND RESPONSIBILITIES
AirWorkspace reserves the right to remove listings from our site at any time;
AirWorkspace is not liable for denial of any services advertised on AirWorkspace, in case the Lessor refuses to provide its Services to the Client;
AirWorkspace reserves its right to change / amend its policies in relation to cancellation of bookings at any time;
AirWorkspace reserves the right to change / alter / vary listings at any time; and
AirWorkspace reserves the right to refuse to list opportunities that are deemed to be a mismatch with the site’s users.
The copyright and all other intellectual property rights in this site belong to AirWorkspace or its licensors. You may not use framing techniques to display this site, any part of it or any other proprietary materials of AirWorkspace.
Unauthorised use of the material, data, design, marks, trademark, copyrights or any information may violate copyright, trademark, and/or other laws. You acknowledge that your use of the content on this website will not be misused in any way or violate any laws prevailing in India or any International laws.

Any errors in the software will be corrected;

AirWorkspace and/or its associates and affiliates do not warrant that this site, its servers, or any mail sent from AirWorkspace will not have viruses or harmful components. If any damage is caused to your computer system and any losses accrue it will not be the responsibility of AirWorkspace. You will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.
AirWorkspace, its associates and affiliates cannot guarantee the accuracy, integrity or quality of any contents. You may be exposed to contents that are offensive, indecent or objectionable. We can only ask you to inform us immediately in order to remove any offensive material.
LIMITATION OF LIABILITY
AIRWORKSPACE ENTIRE LIABILITY, AND YOUR EXCLUSIVE REMEDY, IN LAW, IN EQUITY, OR OTHERWISE, WITH RESPECT TO THE WEBSITE CONTENT AND SERVICES AND/OR FOR ANY BREACH OF THIS AGREEMENT IS SOLELY LIMITED TO THE AMOUNT YOU PAID, FOR SERVICES USED VIA THE WEBSITE. AIRWORKSPACE WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES IN CONNECTION WITH THIS AGREEMENT OR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES THAT YOU MAY CLAIM AGAINST THE LESSOR, INCLUDING LIABILITIES RESULTING FROM (1) THE USE OR THE INABILITY TO USE THE WEBSITE CONTENT OR PRODUCTS OR SERVICES; (2) THE COST OF PROCURING SUBSTITUTE SERVICES; (3) ANY SERVICES PURCHASED OR OBTAINED OR TRANSACTIONS ENTERED INTO THROUGH THE WEBSITE; OR (4) ANY LOST PROFITS YOU ALLEGE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
In no event shall AirWorkspace be liable under contract, tort, strict liability, negligence or any other Legal theory with respect to the site, the service or any content (i) for any lost profits or Special, indirect, incidental, punitive, or consequential damages of any kind whatsoever, (ii) To provide substitute goods or services (however arising), or (iii) for any direct damages.
AirWorkspace invests reasonable due diligence in employing conventionally available security measure to keep data of its users safe. But we take no guarantee of safety of this data if our servers or website application is hacked with malicious intent and user’s data is compromised. If a user has evidence or suspects that some other user is accessing their account to deface it or defame them, the user is expected to seek action from AirWorkspace by informing AirWorkspace. In response, AirWorkspace may bar access of that user to its systems. However, AirWorkspace does not assume responsibility for any subsequent successful hacking attempt of that user by employing persistent creative techniques.
If anyone brings a claim against us related to your actions, content or information on AirWorkspace, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim. Although we provide rules for user conduct, we do not control or direct users’ actions on AirWorkspace and are not responsible for the content or information users transmit or share on AirWorkspace. We are not responsible for any offensive, inappropriate, obscene, unlawful or otherwise objectionable content or information you may encounter on AirWorkspace. We are not responsible for the conduct, whether online or offline, of any user of AirWorkspace.
We do however work to ensure that all information posted on the site is accurate and truthful. We will actively remove content that does not conform to our standards and policies.
